Rising compliance in AU

Here’s the straight story.

Most small businesses turning over less than $3 million are still exempt from the Privacy Act. That’s the current law. Removing the exemption has been proposed for a future round of reforms, but there’s no bill and no date. So if someone tells you it’s already gone, they’re getting ahead of the facts.

The exemption has never applied to everyone. Health service providers, businesses that trade in personal information, credit reporting bodies and several other categories are covered, regardless of turnover. Plenty of businesses assume they’re exempt when they aren’t, so it’s worth taking five minutes to check.

There’s also a real, dated change worth putting in your calendar. From 10 December 2026, organisations covered by the Privacy Act must state in their privacy policy when they use computer programs to make decisions that could significantly affect an individual’s rights or interests. They’ll also need to explain what types of personal information those systems use and what kinds of decisions they make.

Two points are often misunderstood:

  • This is a disclosure requirement in your privacy policy, not an obligation to explain every individual decision.

  • It isn’t an AI-specific rule. It applies to automated systems generally, including the plain rule-based software that’s been quietly making decisions in your business for years.

Separately, and sooner, AML/CTF obligations will extend to real estate professionals, lawyers, conveyancers, accountants, trust and company service providers, and dealers in precious metals and stones from 1 July 2026. If that’s your industry, the small business exemption falls away for the personal information you handle for AML/CTF purposes.

You've made it this far, so you've probably decided unmanaged AI is starting to feel a bit risky (and a bit expensive for what you're getting).

The next step is finding a managed AI partner who actually understands your goals and how your business runs day to day, not just how the tech works in theory.

Deep business/industry understanding

There are many managed AI service providers out there. So you want a partner who understands your business and your industry, so they're not learning the basics of your world on your time and budget.

An IT provider who only knows AI and nothing about your business is a disaster waiting to happen. They should already know how typical systems in your space behave, where the data lives, what can go wrong, and what "good" looks like. From there, they can map out sensible options, explain the trade-offs in plain English, and implement the right fit properly the first time.  

Sets up data and AI governance from the get-go

Look for an AI managed service provider that prioritises governance and bakes it in from day one.

Your data is one of your most valuable business assets.

Once you connect it to AI, you need clear, practical controls around how it's used, such as:

  • an acceptable-use policy your team can actually follow

  • an approved tools list

  • guidance on what data goes where

  • and an incident and escalation process for when something goes sideways

If governance barely rates a mention in their AI pitch, it's a sign to keep looking.

Honest about what's actually included

Like any other tool, AI needs attention over time. It needs ongoing tweaks, updates, and improvements, not just someone to poke it when it breaks.

When you're weighing up providers, ask exactly what happens in a normal month and what happens when something breaks.

If the answer is a wall of words like "proactive," "continuous", and "24/7" with nothing specific behind them, ask again.

Scheduled reviews and responsive support, clearly described, are worth more than vague promises of constant vigilance. A provider willing to tell you what isn't covered is usually telling you the truth about what is.

Transparent processes and answers

You'll want a managed AI service provider who can tell you, in plain English, how your data is handled and where it actually lives.

No hand-waving, no vague "in the cloud somewhere" answers.

Since we're asking it of others, here's ours: Claude runs on Anthropic's infrastructure in the United States, so your prompts and the documents you share with it are processed offshore. Under Anthropic's commercial terms, your business data isn't used to train their models. Where we integrate Claude with your own systems, that integration layer runs in Microsoft's Azure Australia East region. So the integration sits locally; the AI processing does not. Every client signs off on that in writing before we start.

A good MSP will happily put that detail in writing, with documentation that covers the full lifecycle of your AI setup: from evaluation and design, through implementation, to day-to-day support.

This part is worth pinning down before you sign anything.

Clear about the total cost

An AI managed service isn't the only line on the invoice. There's the AI platform licence itself, usually charged per person, and the managed service on top.
